By accessing or using our website https://www.gotstarstudio.com (the "Site") or mobile applications (the "Apps", collectively referred to as the "Services"), you agree to be bound by this Terms of Service. If you do not agree to these terms, please cease all use of the Services immediately.

1. Agreement to Terms

Your ongoing use of the Services signifies that:

(a) You have read and comprehended these Terms;

(b) You agree to abide by these Terms and all applicable laws and regulations;

(c) You accept any future updates to these Terms published on the Site.

2. Qualification and Account Obligations

To use the Services, you must be at least 16 years old (or the minimum age required by your local laws, whichever is higher). Users under the age of 18 (or the age of majority in your jurisdiction) must obtain consent from a legal guardian.

You guarantee that all information provided for your account is accurate, up-to-date, and complete. Failure to maintain such information may lead to account suspension or termination. You are responsible for safeguarding your account password and must notify GOTSTAR STUDIO PTE. LTD. ("we", "us") immediately upon discovering any unauthorized access to your account. You shall bear full responsibility for all activities conducted through your account. We reserve the right to implement age verification procedures for high-risk transactions.

3. Intellectual Property Rights

All content within the Services (including but not limited to text, graphics, software, and other materials) is owned by GOTSTAR STUDIO PTE. LTD. or its licensors and is protected by global intellectual property laws. We grant you a limited, non-exclusive, and non-transferable license to access such content solely for personal, non-commercial use. You should not:

• Modify, reproduce, distribute, or create derivative works based on the content;
• Remove any copyright or trademark notices;
• Use the content for commercial purposes without prior written approval from us.

4. Privacy Policy

By using the Services, you acknowledge that we may collect, use, and share your information as described in our Privacy Policy. If you do not agree with the Privacy Policy, you must stop using the Services. Details of data processing activities are available in our Privacy Policy (https://www.gotstarstudio.com/privacy).

5. Content and Content Rights

For the purposes of these Terms: (i) "Content" refers to text, graphics, images, music, software, audio, video, literary works, and any other information or materials posted, generated, provided, or made available through the Services; (ii) "User Content" refers to any Content provided by account holders (including you) for availability through the Services. Content includes, without limitation, User Content.

5.1. Ownership

GOTSTAR STUDIO PTE. LTD. claims no ownership rights to User Content. However, by providing User Content, you grant us a perpetual, worldwide, royalty-free license to use, modify, distribute, and publicly perform such content for the purpose of operating the Services.

5.2. Warranties

You are solely responsible for all your User Content. You represent and warrant that:

• You own all rights to your User Content, or you have obtained all necessary rights to grant us the license as specified in these Terms;
• Your User Content, its provision through the Services, and our use of it on or through the Services will not infringe, misappropriate, or violate any third party's intellectual property rights, rights of publicity or privacy, or any applicable laws or regulations.

5.3. Right to Remove

We are not liable for the removal or deletion of (or failure to remove or delete) any of your User Content.

6. Rights and Terms for Apps

Upon compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to:

• Install one copy of the App on devices you own;
• Use the App solely for personal, non-commercial purposes.

Prohibited actions include:

• Reverse engineering, decompiling, or disassembling the App;
• Unauthorized distribution or commercial exploitation of the App;
• Enabling multi-user access to the App.

Commercial screen recording of the App requires prior written authorization from us.

7. General Prohibited Conduct and Our Enforcement Rights

You agree not to engage in any of the following:

• Post, upload, publish, submit, or transmit any Content that: (i) infringes, misappropriates, or violates a third party's patents, copyrights, trademarks, trade secrets, moral rights, or other intellectual property rights, or rights of publicity or privacy; (ii) violates or encourages conduct that violates any applicable law or regulation, or gives rise to civil liability; (iii) is fraudulent, false, misleading, or deceptive; (iv) is defamatory, obscene, pornographic, vulgar, or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group; (vi) is violent, threatening, or promotes violence or threats against any person or entity; (vii) promotes illegal or harmful activities or substances.
• Use, display, mirror, or frame the Services (or any element within them), our name, trademarks, logos, other proprietary information, or the layout/design of any page or form on the Site, without our express written consent.
• Access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our service providers.
• Attempt to probe, scan, or test the vulnerability of our systems or networks, or breach any security or authentication measures.
• Avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measures implemented by us, our providers, or other third parties (including other users) to protect the Services or Content.
• Attempt to access, search, or download Content from the Services using any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, data mining tools, etc.) other than the software or search agents provided by us or generally available third-party web browsers.
• Send unsolicited or unauthorized advertising, promotional materials, emails, junk mail, spam, chain letters, or other solicitations.

• Use meta tags or other hidden text/metadata containing our trademarks, logos, URLs, or product names without our express written consent.
• Use the Services, Content, or any portion thereof for commercial purposes, for the benefit of third parties, or in any manner not permitted by these Terms.
• Attempt to decipher, decompile, disassemble, or reverse engineer any software used to provide the Services or Content.
• Interfere with or attempt to interfere with access to any user, host, or network, including (but not limited to) sending viruses, overloading, flooding, spamming, or mail-bombing the Services.
• Collect or store personally identifiable information from other users of the Services without their express permission.
• Impersonate others or misrepresent your affiliation with any person or entity.
• Violate any applicable laws or regulations.
• Encourage or enable others to engage in any of the above.

While we are not obligated to monitor access to or use of the Services/Content, or to review, display, or edit any Content, we reserve the right to do so to operate the Services, ensure compliance with these Terms, and meet applicable legal requirements. We may, at our sole discretion, remove or disable access to any Content at any time without notice if we deem it objectionable or in violation of these Terms. We also reserve the right to investigate violations of these Terms or conduct affecting the Services and may cooperate with law enforcement authorities to prosecute users who violate the law.

8. Copyright Infringement Policy

GOTSTAR STUDIO PTE. LTD. respects copyright laws and expects users to do the same. We will terminate accounts of users who repeatedly infringe or are believed to repeatedly infringe the copyrights of others, in appropriate circumstances.

The Digital Millennium Copyright Act provides a mechanism for copyright owners to address infringements online. If you believe your copyrighted work has been used without authorization on the Services, you may submit a notice containing the following:

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
• A description of the infringed copyrighted work;
• A description of where the infringing material is located on the Services;
• Contact information (address, phone number, and email, if available) to allow us to reach you;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

9. Payment Terms

9.1 Virtual Items

(a) License Grant

We license virtual goods obtainable through purchase, gameplay, or redemption ("Virtual Items"). Upon obtaining Virtual Items, you receive a limited, personal, non-transferable, non-sublicensable, and revocable license to use them within the applicable App solely for non-commercial purposes.

(b) Modifications and Restrictions

We reserve the right to manage, modify, or discontinue Virtual Items at any time without notice.

Virtual Items may not be transferred unless specifically allowed by the App's features.

They have no monetary value, cannot be redeemed for cash, and may not be sold or traded.

(c) Purchases and Refunds

Except as required by mandatory local laws, all Virtual Item purchases are final and non-refundable. You acknowledge that we are not obligated to provide refunds for Virtual Items under any circumstances, including (but not limited to):

• Account deletion or termination;
• Discontinuation of the App or Services;
• Loss of Virtual Items due to unauthorized access or system failures.

(d) Usage and Termination

• Virtual Items may only be redeemed for in-App gameplay entitlements.
• Unused Virtual Items will be forfeited without compensation upon account deletion, termination, or cessation of App use.
• Requesting erasure of your personal data under our Privacy Policy will permanently forfeit all Virtual Items without refund.

9.2 Subscriptions

(a) Subscription Mechanism

Purchasing a subscription grants immediate access to services and monthly recurring charges.

Payments for subscriptions made through third-party stores (e.g., Apple App Store, Google Play) are governed by the platform's terms.

(b) Free Trials

Trial subscriptions automatically convert to paid subscriptions unless canceled before the trial ends.

Activating a paid subscription will forfeit any remaining trial period.

(c) Renewal and Cancellation

Subscriptions renew automatically unless canceled before the renewal date.

Cancellation must be done through platform-specific tools (e.g., iOS Account Settings, Google Play Subscriptions). Email requests for cancellation are invalid.

Failure to pay renewal fees will result in automatic termination of the subscription.

(d) Pricing and Refunds

PAID SUBSCRIPTION FEES ARE NON-REFUNDABLE EXCEPT AS REQUIRED BY APPLICABLE LAW.

Rates are quoted in USD; local currency equivalents will fluctuate with exchange rates.

Price changes will be notified in advance and take effect at the next renewal.

(e) Modification Rights

We may modify subscription fees with advance notice. If you do not accept the changes, the subscription will terminate at the end of the current period.

10. Links to Third-Party Resources

The Services and Apps may contain links to third-party websites or resources. These links are provided for convenience only, and we are not responsible for the content, products, or services available on such sites or resources, or for links displayed on them. You assume sole responsibility and all risks arising from your use of third-party websites or resources.

11. Termination

We may, at our sole discretion, terminate your access to the Services at any time without notice. Upon termination, discontinuation, or cancellation of the Services or your account, all provisions of these Terms that by their nature should survive will remain in effect, including (but not limited to) ownership clauses, warranty disclaimers, liability limitations, and dispute resolution provisions.

12. Warranty Disclaimers

THE SERVICES AND CONTENT ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE IN TRADE.

We do not warrant that the Services will meet your requirements, or that they will be available uninterrupted, securely, or error-free. We make no warranties regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any Content.

13. Indemnification

You agree to indemnify and hold harmless GOTSTAR STUDIO PTE. LTD., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs (including reasonable legal and accounting fees) arising from or related to: (i) your access to or use of the Services or Content; (ii) your User Content; (iii) your violation of these Terms.

14. Limitation of Liability

NEITHER WE NOR ANY PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES OR CONTENT SHALL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING (BUT NOT LIMITED TO) LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR IN CONNECTION WITH these Terms OR THE USE OF (OR INABILITY TO USE) THE SERVICES OR CONTENT. THIS APPLIES TO ALL LEGAL THEORIES, INCLUDING (BUT NOT LIMITED TO) WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A LIMITED REMEDY HEREIN IS FOUND TO HAVE FAILED IN ITS ESSENTIAL PURPOSE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHOULD OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS; OR (B) TWENTY US DOLLARS (USD 20).

THE LIMITATIONS AND EXCLUSIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL TO THE AGREEMENT BETWEEN YOU AND US.

15. Time Limit for Claims

You agree that any claim arising from or related to your relationship with us must be filed within one year of the claim arising; otherwise, the claim is permanently barred.

16. Governing Law and Jurisdiction

These Terms and any related disputes shall be governed by the laws of Singapore without regard to its conflict of law principles.

You and we agree that any dispute, claim, or controversy arising from or related to the Services (including non-contractual disputes) that is not subject to mandatory arbitration shall be resolved by the courts of Singapore.

17. Dispute Resolution

If you encounter issues with the Services, many can be resolved through our forums. Before initiating formal legal proceedings, please contact our support team via the App to address your concerns. Most disputes can be resolved this way.

18. General Terms

(a) Entire Agreement

These Terms constitutes the complete and exclusive understanding between you and GOTSTAR STUDIO PTE. LTD. regarding the Services, replacing all prior oral or written agreements.

(b) Severability

If any provision of these Terms is deemed invalid or unenforceable by a court, it shall be enforced to the maximum extent permitted, and all other provisions shall remain fully effective.

(c) Assignment

You may not assign these Terms without our prior written consent; any attempted assignment without consent is void. We may freely assign these Terms without restriction. these Terms binds and benefits the parties, their successors, and permitted assigns.

(d) Notices: We may provide notices (including updates to these Terms) via posting on the Services.

(e) Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of ours. The exercise of any remedy does not prejudice other rights.
